Sale Terms and Important Information

PLEASE NOTE

First Choice Machinery Ltd do not warrant ANY Lot and no warranty is implied by law. Every Lot in every auction is sold as seen. Any Bid placed will be treated as absolute evidence that the bidder has completely contented themselves with the condition of the item or items.

Terms & Conditions for First Choice Machinery Ltd Auction:

These Terms and Conditions (“Agreement”) govern your participation in the auction organized by First Choice Machinery Ltd (“Auctioneer,” “we,” or “us”). By registering for and/or participating in the auction, you (“Bidder,” “Buyer,” or “you”) agree to be bound by these Terms and Conditions.

1. Eligibility

• You must be at least [Insert Age, e.g., 18] years old to participate in the auction.

• To participate in the auction, you must register with the auction house before the auction begins. Registration may require personal identification and payment details.

• By registering, you confirm that you are legally able to enter into binding contracts.

2. Bidding Process

• Bids: All bids are final and cannot be retracted once placed. By placing a bid, you are offering to purchase the item(s) at the price indicated.

• Reserve Price: Some items may have a reserve price (minimum price). If the reserve price is not met, the item may not be sold.

• Auction Ending: The auction will close at the specified time, and the highest bid at the close of the auction will be considered the winning bid unless otherwise specified.

• Automatic Bidding: If the auction platform allows, automated bids may be placed on your behalf up to your maximum bid limit.

3. Winning Bid and Payment

• Winning Bid: The highest bid placed before the auction closes will be considered the winning bid for the item(s). In case of a tie or dispute, First Choice Machinery Ltd will have the discretion to resolve the issue.

• Payment: The winning bidder is required to pay the full amount of the winning bid, plus any applicable taxes, fees, and shipping charges, prior to collection and within 48hrs of receiving the invoice.

• Payment Methods: Payments must be made via bank transfer.

4. Buyer’s Premium

• In addition to the winning bid amount, the buyer may be subject to a buyer’s premium, which will be 16% + VAT of the winning bid and will be added to the final invoice.

5. Delivery and Collection

• Shipping: For online auctions, the winning bidder will be responsible for collection and for all documentation and transportation costs.

• Collection: If the auction allows for in-person collection, the winning bidder is required to collect the items within 14 days of the auction’s close. Failure to collect will result in storage fees or cancellation of the sale. Further T&C’s are stipulated in the ‘Shipping Section’

6. Condition of Items

• All items are sold “as-is,” with no warranties or guarantees, unless otherwise specified in the item description.

• Inspection: Bidders are encouraged to inspect the items before placing a bid. Descriptions of the items provided are for general informational purposes, and while accurate to the best of our knowledge, no guarantees are made regarding the condition or quality of the items.

7. Auctioneer’s Discretion

• First Choice Machinery Ltd reserves the right to:

• Refuse any bid at its discretion.

• Cancel or postpone the auction or any part of it.

• Withdraw any item from the auction before the bidding ends.

• Resolve any disputes over bidding, including but not limited to errors in bids, bidding mistakes, or unclear circumstances.

8. Bidder’s Responsibility

• Legality: Bidders must comply with all applicable local, national, and international laws.

• Accuracy: Bidders must ensure that all information provided during the registration and bidding process is accurate and up-to-date.

• Non-Transferability: Bidders may not transfer or assign their bids to another person without prior written consent from First Choice Machinery Ltd.

9. Failure to Pay or Collect

• If the winning bidder fails to make full payment or collect the item(s) within the specified time frame, First Choice Machinery Ltd reserves the right to:

• Cancel the sale and re-auction the item.

• Charge a penalty or storage fee for delayed collection.

• Pursue legal action for non-payment or breach of contract.

10. Liability

• Limitation of Liability: First Choice Machinery Ltd is not responsible for any loss, damage, or injury resulting from participation in the auction or the use of any items purchased in the auction.

• Indemnification: You agree to indemnify and hold harmless First Choice Machinery Ltd and its affiliates, employees, and agents from any claims, damages, or liabilities arising out of your participation in the auction or breach of these Terms and Conditions.

11. Privacy

• By participating in the auction, you consent to the collection and use of your personal information in accordance with our Privacy Policy detailed on www.firstchoicemachinery.co.uk. Your personal information will be used for registration, invoicing, and communication regarding the auction and payment.

12. Governing Law and Dispute Resolution

• These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom.

• Any disputes arising from these Terms and Conditions will be resolved through arbitration/mediation in the United Kingdom.

13. Miscellaneous

• Entire Agreement: This Agreement represents the entire understanding between the parties regarding the auction and supersedes all previous agreements or understandings, whether written or oral.

• Amendments: First Choice Machinery Ltd reserves the right to amend or update these Terms and Conditions at any time. Any changes will be communicated via Email.

By registering for or participating in the auction, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
