CONDITIONS OF SALE
STANDARD CONDITIONS FOR SALE OF GOODS BY AUCTION
GARC (Global Asset Resale Company) is a trading name of Aspire IT Services Ltd.
Please read the information and Terms & Conditions of sale below before bidding.
Before bidding please note the following summary;
PRODUCT DESCRIPTION
We make every effort to describe the goods and condition of the goods correctly. However, you must take your own due diligence to inspect the product before bidding. We offer 'inspection days' so you can check the item before bidding, by appointment only. See the auction description page for details of these dates. We take no liability for the condition of the product, it is sold as seen and there are no refunds.
COLLECTION ONLY
All auction items are COLLECTION ONLY. We do not DELIVER items.
This means you must make your own arrangements to collect the goods from our warehouse.
You may arrange your own courier to collect on your behalf. You can use a service such as parcel2go.com to arrange.
If you wish to arrange your own courier, you must notify us before making payment, so we can add the packing fee on to your invoice. Details below.
PROCESSING TIME
Your order will ready for collection 24 hours after we receive payment.
PACKING CHARGE
If you use your own courier, we will charge you a packing fee to prepare goods for shipment as below:

£30+vat (large item e.g. laptop size upwards or multiple items)
Pallet packing price POA.
We will wrap your parcel as securely as possible but we take no liability for damage in transit, so we advise that you take your own insurance.
OPERATING SYSTEM
Some of our items will be auctioned without an operating system. These will be clearly stated on the listing.
If you require this to be installed there will be an additional charge:

AUCTION REGISTRATION
We use ATG’s, iBidder (www.i-bidder.com) and Bidspotter (www.bidspotter.co.uk) platforms to host our online auctions. In order to place a bid on any of our lots and to take place in our auctions you will first need to first register an account with the appropriate platform online.
Once you’ve created a ‘Bidders Account’ you can sign up to bid on any sales listed through iBidder or BidSpotter platforms.
Upon submitting your registration to bid, You may require ‘Manual Bidding approval by the Auctioneer’, in which case it may be several hours after signing up before you are approved. We recommend that you sign up to auctions well in advance.
You may be required to provide additional information to your ‘Buyers Account’
GARC may require a copy of a Drivers License and or a utility bill to confirm the identity of the ‘Account Holder’
Please ensure that you read all the rules before signing up to any particular auction and in particular that you are able to pay by one of the approved methods and collect on time.
PAYMENT
Balances must be paid in full within two working days after the sale closes.
We do not accept cash, banker's drafts or cheques. Payments should be made by Bank Transfer and must be cleared in our account prior to collection. Please quote your bidder number to assist us.

COLLECTION
Collection only, however we may be able to assist buyers in arranging delivery as a convenience. Nevertheless any such delivery service is entirely separate from the contract for the purchase of the goods.
Collection by appointment only (book via phone or email)
Collections can only be made after all lots purchased have been paid for in full.
Once payment has been received in full, collections have to be made within two working days of the sale closing.
Any items that have been paid for but not collected within the set period for collection will result in a default on the terms of sale at the discretion of the auctioneers. Any such items may be resold at any stage and the original buyer will be refunded a maximum of the original hammer price less storage and sale charges.
Lots are sold as is and where they lie. GARC disclaim all responsibility for loss or damage to goods caused by purchasers and contractors in the collection or delivery of goods purchased.
ALL SALES ARE SUBJECT TO THE FOLLOWING CONDITIONS
The Buyer acknowledges that a Sale by Auction is not a consumer sale for the purposes of the Sale of Goods Act 1979 (as amended by the Sale and Supply of Goods Act 1994) and the Unfair Contract Terms Act 1977 and the Buyer shall not seek to rely upon and conditions or warranties implied thereby or by any other legislation.
THE HEALTH AND SAFETY AT WORK ACT, 1974
The goods are not sold as articles for use at work, or at home, they are sold on the understanding that the vendor does not represent them as being in a condition which makes them suitable for use at work or home. Oil/gas fired, electrical appliances, machinery, plant or equipment are sold as scrap or for refurbishment only, and in their current condition are not necessarily compliant with the requirements of the Health and Safety at Work Act 1974 and the Consumer Protection Act 1987. All purchasers should understand that before using the items at work or selling them on to the consumer for use, they must undertake to refurbish the items and render them compliant with the aforementioned acts.
General Terms and Conditions of Sale
These terms and conditions ("Terms") govern the auction services provided by Aspire IT Services Ltd, trading as GARC ("the Auctioneer"). By participating in our auctions, you agree to be bound by these Terms.
1. Agency
1.1. The Auctioneer acts solely as an agent for both buyers and sellers. We hereby disclaim any responsibility for defaults by either party. 1.2. We do not guarantee the title of any lot or lots sold through our auctions, and we are not liable for any defects in such title.
2. The Buyer
2.1. The highest bidder acknowledged by the Auctioneer will be deemed the buyer. 2.2. In the event of a dispute, the Auctioneer has absolute discretion to settle the matter. 2.3. Bidding cannot be retracted, and the Auctioneer reserves the right to refuse any bid. 2.4. The Auctioneer may bid on behalf of the seller for any lot and has the right to withdraw, consolidate, or divide any lot.
3. Ownership of Purchases
3.1. Ownership of purchased lots does not transfer to the buyer until full payment is received by the Auctioneer. 3.2. No lots may be removed until payment for all purchased lots is made in full.
4. Transfer of Risk
4.1. Each lot is held uninsured at the purchaser's sole risk from the fall of the hammer. 4.2. Lots are sold with all faults and imperfections, and the Auctioneer is not responsible for the correctness of descriptions, genuineness, or authenticity. 4.3. Buyers are deemed to have inspected lots and satisfied themselves as to their condition.
5. Collection
5.1. Collections can only be made after full payment for all purchased lots. 5.2. Buyers are responsible for bringing necessary labour, lifting equipment, and ensuring safe removal of their lots. 5.3. Late collections may incur storage charges and can only be made by appointment. 5.4. Failure to comply with collection terms may result in the Auctioneer reselling the lots without notice.
6. Movement of Lots
6.1. The Auctioneer reserves the right to move lots that restrict the use of auction premises. 6.2. Movement of lots is at the purchaser's risk, and the Auctioneer is not liable for any loss or damage incurred.
7. Liability of Bidders
7.1. Bidders are deemed to have authority for each bid made and are equally liable with their principal for all obligations and liabilities. 7.2. Online bidders must ensure they have the authority to bind the registered entity and keep login credentials secure.
8. Damage
8.1. Any damage to lots or premises is the responsibility of the party committing such damage.
9. Descriptions
9.1. Lots are sold as-is, and no guarantee is made regarding performance, condition, or suitability for purpose. 9.2. The Auctioneer is not responsible for errors or mistakes in descriptions and makes no representations or warranties.
10. Third-Party Liability
10.1. Visitors to the premises indemnify the vendor and the Auctioneer against any claims arising from their presence. 10.2. The Auctioneer does not endorse or guarantee the competence of any organization or its representatives.
11. Additional Items
11.1. Items found with lots but not listed in the catalogue are reserved for the vendors and may not be removed.
12. Provisional Bids / Reserves
12.1. The Auctioneer may place reserves on lots and has discretion to accept bids below reserve after bidding closes.
13. After Sales
13.1. All post-sale transactions are subject to these Terms.
14. Health and Safety Regulations
14.1. The Auctioneer and vendors are not responsible for lots that contravene health and safety regulations.
15. Time
15.1. Time is of the essence for all Terms and Conditions.
16. Software
16.1. Lots sold without software unless specified otherwise, and buyers must remove all unauthorized software.
17. Indemnity
17.1. Buyers indemnify the Auctioneer and vendors for any breach of these Terms.
18. No Transfer of Lots
18.1. Transfer of lots by buyers is prohibited.
19. Important Notice
19.1. Prospective purchasers are advised to thoroughly read and understand these Terms before bidding.
20. Auctions / Tender / Private Treaty
20.1. These Terms apply to all sales conducted by the Auctioneer, regardless of the method of sale.
21. Random Searching of Vehicles
21.1. The Auctioneer has the right to search vehicles leaving the premises to verify contents.
22. Parking
22.1. Parking on the premises is at the owner's risk.
23. Road Traffic Act Requirements
23.1. Buyers are responsible for ensuring vehicles comply with road traffic regulations before use.
24. Export of Goods
24.1. Buyers are responsible for obtaining necessary export licenses for goods purchased.
25. Lots
25.1. The Auctioneer is not obligated to make any inquiries regarding lot titles.
26. Rescission By Vendor
26.1. Vendors may rescind sales and refund purchasers if unable to provide good title or delivery.
27. Variations
27.1. No variations to these Terms are valid without written authorization from a Director.
By participating in our auctions, you agree to abide by these Terms.
