1. Terms and Conditions

Infinity Auctions Network Ltd (referred to herein as "Infinity Auctions Network", "we", or "the Auctioneer") strongly advises all account holders/bidders to read and understand these Terms of Sale prior to registering and submitting any bids.

All auctions conducted by Infinity Auctions Network Ltd operate as trade-only auctions, where participants must act as business entities. By participating in our auctions, buyers ("Buyer" or "you") acknowledge and accept that the sale is not a business-to-consumer contract.

Trade-only auctions are not governed by the Sale of Goods Act 1979, the Consumer Rights Act 2015, Unfair Contract Terms Act Regulations 1977/1999, or any other consumer contract-related legislation. By bidding, you acknowledge and agree to this exclusion and shall not seek to rely upon any conditions or warranties implied thereby.

By registering and bidding on lots within our auctions, the “Account Holder” confirms that they have conducted their own research, performed due diligence, and fully inspected the lots they intend to bid on.

The “Account Holder” agrees that Infinity Auctions Network (including its vendors) makes no representations, warranties, or guarantees of any kind.

By registering to bid, the “Account Holder” accepts these Terms of Sale (or Terms & Conditions) and indemnifies the “Auctioneer – Infinity Auctions Network Ltd” and any of its vendors against any claims relating to fitness for use or purpose.

1.0 Bidding

1.1. Once you have created your bidding account, you may register to bid.

1.2. Manual approval by the Auctioneer may be required. Infinity Auctions Network reserves the right to decline any bidder account.

1.3. The “Account Holder” may be required to provide additional information to verify their eligibility for bidding approval.

1.4. Additional identification may be required, such as a Driver’s Licence or utility bill.

1.5. During registration, you will be required to agree to the Terms of Sale / Terms & Conditions.

1.6. All bids placed are legally binding and cannot be withdrawn at any time under any circumstance.

1.7. The “Account Holder” is responsible for all bidding activity. By participating in the auction, the “Account Holder” agrees to complete any purchases resulting from Winning Bids or Provisionally Accepted Bids on lots they have bid on.

1.8. The “Account Holder” hereby confirms they are 18 years of age or older.

2.0 Winning Bids / Payment

2.1. If you are the winning bidder for any Lot(s), an invoice will be sent to the email address associated with your bidding account. It is the Account Holder’s responsibility to monitor their email inbox, including any junk/spam folders.

2.2. All lots purchased are subject to a payment deadline. Payment must be made within 24 hours of the invoice being issued.

2.3. All payments must be made by bank transfer only, using the bank details provided on the invoice. We do not accept cash, cheques, card payments, or any other form of payment besides bank transfer.

2.4. Please ensure that the invoice number is used as the payment reference.

2.5. Bidders are reminded to only place bids if they intend to fully adhere to these Terms & Conditions.

3.0 Reserves / Provisional Bids

3.1. Reserve prices may be amended at any time, both during and after the sale.

3.2. In instances where a bid on any Lot(s) does not meet the specified reserve, the bidder authorises Infinity Auctions Network to submit the highest bid tendered by the Account Holder to the Vendor(s) for their consideration.

3.3. Should the Vendor(s) opt to accept the highest bid presented by the Account Holder within 24 hours of submission, the Account Holder will be promptly invoiced, with payment due by 5:00 pm on the following day.

3.4. Bidding on any Lot(s) does not necessarily require the Account Holder to be the highest bidder to secure the item. Infinity Auctions Network retains the right to submit all bids to the Vendor(s) for review. Accordingly, bids placed on single or multiple lots remain valid for 24 hours after the sale’s conclusion.

3.5. If the Vendor(s) decide to accept your “Maximum Bid,” the “Account Holder” will be notified within 24 hours of the auction ending by way of a payable invoice, along with a specified payment deadline.

4.0 Lot End Times & Removal

4.1. Infinity Auctions Network reserves the right, at its sole discretion, to withdraw or remove any Lot(s) from sale at any time, without prior notice to the Account Holder or other parties.

4.2. For “Timed Auctions,” Infinity Auctions Network reserves the right to amend, alter, or modify the designated end times for any Lot(s) without prior notice.

4.3. Infinity Auctions Network clarifies that all items (“lots”) are available at the time of listing, but Infinity Auctions Network Ltd does not guarantee their continued availability after the auction concludes (commonly referred to as “after the hammer has fallen”). This acknowledges that circumstances beyond Infinity Auctions Network’s control may affect an item’s availability.

4.4. Infinity Auctions Network accepts no liability for any item that becomes unavailable after the auction or if the seller fails to supply the item. This includes, but is not limited to, scenarios where an item is lost, damaged, or withdrawn by the seller.

4.5. In line with this policy, Infinity Auctions Network will not entertain claims related to the unavailability of items, thereby reinforcing our position of non-liability in such cases.

4.6. As a remedy in situations where an item has been paid for but subsequently becomes unavailable, Infinity Auctions Network commits to providing a full refund of the invoiced amount to the buyer.

4.7. When a lot is closing, if another “Account Holder” places a bid on that Lot, the end time will be extended by up to 10 minutes (system-generated). This extension will occur each time a bid is placed within the final 10 minutes of the lot’s closing.

5.0 Buyer’s Premium / Fees

5.1. Each individual lot carries a Buyer’s Premium ranging from 10% to 25% of the hammer price. This may vary from lot to lot. Refer to the “Additional Fees” tab on each individual lot for precise fees.

5.2. All Buyer’s Premium charges are subject to VAT at 20%.

5.3. Each lot may be subject to an internet surcharge ranging from 1% to 5%, also subject to VAT at 20%. Please refer to the “Additional Fees” tab for clarification.

6.0 VAT Charges

6.1. All lots will be subject to VAT at 20%, applicable to both the hammer price and the Buyer’s Premium/fees, unless otherwise stated in the lot description.

6.2. Certain lots may be sold without VAT on the hammer price. Please refer to the lot description for clarification.

7.0 VAT Refunds / Export

7.1. Buyers intending to export a Lot will be charged an additional deposit equal to the VAT due on each Lot purchased.

7.2. To qualify for a VAT refund, goods must be exported in accordance with the relevant export regulations. Valid written evidence of compliance should be submitted by the Buyer to the vendor at their registered address and to the Auctioneer via email (admin@infinityauctions.network) within 28 days of the date of invoice. The Auctioneer does not take ownership of any Goods sold and therefore accepts no liability for VAT refunds unless specifically agreed by all parties prior to sale. The Auctioneer’s role is to facilitate communication between the buyer and the seller.

7.3. If satisfactory evidence is not provided, Goods will be subject to UK VAT at the standard rate, and the Buyer will forfeit any deposit paid under clause 7.1.

7.4. The Auctioneer cannot refund VAT on the Buyer’s Premium under any circumstances.

7.5. If the Buyer chooses to export their purchases using their own transport, VAT will be levied and subsequently refunded upon receiving sufficient documentation demonstrating the removal of the Goods purchased, assuming compliance with clause 7.2.

7.6. Notwithstanding any other clause in these Conditions, the Auctioneer reserves the right to refuse:

• to accept any bid from a Bidder; or
• to sell any Lot (in whole or in part) to a Buyer.

8.0 Viewing of Lots

8.1. Infinity Auctions Network advises prospective buyers to arrange viewing of all Lots prior to bidding.

8.2. Viewing is strictly by appointment only. It must be scheduled prior to placing any bid(s) on the lot(s) you wish to inspect and before the auction ends.

9.0 Description Accuracy

9.1. As an agent of the seller, Infinity Auctions Network provides lot descriptions based on information supplied by the seller. However, no warranty or representation is made regarding the accuracy of these descriptions.

9.2. Buyers are encouraged to thoroughly inspect images and descriptions, and to request further information, if necessary, prior to placing a bid.

9.3. All lots are sold “as seen,” with no guarantees or warranties, whether expressed or implied. It is the Account Holder’s responsibility to conduct adequate due diligence.

9.4. Descriptions and images are supplied by the seller at the time of listing.

9.5. Any mileage/hour reading in a description is not deemed “warranted” unless expressly stated.

9.6. Infinity Auctions Network performs only a basic check to confirm that a vehicle is not stolen, relying on the information provided. As a third party, Infinity Auctions Network shall not be held liable for any inaccuracies. We do not check for insurance write-offs or previous accidents. Bidders are responsible for carrying out their own investigations regarding a vehicle’s insurance history. Additionally, bidders must ascertain whether any outstanding finance or title issues exist prior to bidding. Should outstanding finance be discovered post-purchase, this matter must be addressed directly with the seller, as Infinity Auctions Network is not a party to the contract between buyer and seller.

10.0 Lot Images

10.1. Images are provided by the seller at the time of listing.

10.2. Images of lots are for guidance purposes only and should not be relied upon to ascertain the true condition of any item.

10.3. In certain instances, lots within the auction may display “stock images.” These are for illustration purposes only.

11.0 Registration Plates

It is incumbent upon the “Account Holder” to carry out their own due diligence on any visible registration plate featured in the provided images.

11.1. Certain lots may be listed with a “Private Registration Number.” In such cases, it is the Account Holder’s responsibility to ascertain whether the private number plate is included in the sale.

11.2. No “Private Registration Number” is deemed included in the sale unless expressly stated.

12.0 Collections

12.1. Upon receipt of payment, Infinity Auctions Network will issue the collection details to the email address on the bidding account.

12.2. Collections are strictly by appointment only. Should no appointment be made, collection may be refused.

12.3. The collection process and instructions are determined by the seller of the lot(s).

12.4. In certain circumstances, lots may have specific collection dates/times stated in the auction details or the individual lot description. Failure to collect within these specified dates may result in storage charges or disposal of the lot(s) without refund.

12.5. A grace period of 5 days is granted for collection. From the 6th day, a storage charge of 5% plus VAT per day, subject to a minimum charge of £20 plus VAT per day, will be applied.

12.6. Goods will only be released once all applicable fees are settled. Failure to pay such fees or collect Goods within 20 days will result in the Goods being deemed abandoned, with ownership transferring to Infinity Auctions Network, and no refund shall be provided.

13.0 Delivery

13.1. As the Auctioneer, Infinity Auctions Network does not offer delivery on any lot.

13.2. A lot description may state that delivery is available based on information provided by the vendor.

13.3. If a vendor can offer delivery, the quote will only be provided once the full invoice has been paid.

13.4. Infinity Auctions Network shall not be held liable for any loss, damage, or inconvenience arising from a delivery arranged by the seller. No refund will be issued as a result of delivery issues or failures. Such matters are strictly between the buyer and the seller.

14.0 Storage Charges

14.1. Infinity Auctions Network reserves the right to charge a daily storage fee of 5% plus VAT per day, with a minimum charge of £20 plus VAT per day, for any failure to collect within the terms specified in Clause 12.0 (Collections). These charges apply 7 days a week, including bank holidays.

14.2. Storage charges are levied per lot at the rate stated in Clause 14.1.

14.3. Storage charges must be paid in full before any Lot(s) will be released for collection or delivery.

14.4. Failure to collect Goods within 20 days of receiving the collection details will result in the lot(s) being deemed abandoned, with ownership transferring to Infinity Auctions Network, and no refund shall be given.

15.0 VDI Checks

15.1. All lots with a visible “registration number” have been subject to a VDI check by Infinity Auctions Network prior to listing.

15.2. All details included in the description are accurate to the best of our knowledge at the time of listing.

15.3. Infinity Auctions Network advises all bidders to undertake their own research and due diligence before placing a bid to ensure complete satisfaction.

16.0 Refunds / Buy Backs / Renegotiations

16.1. Infinity Auctions Network and its vendors emphasise that no refunds, buybacks, renegotiations, or contributions will be provided should buyers find themselves dissatisfied with any purchased lot(s). Prospective buyers must carefully evaluate each purchase before bidding.

17.0 Terminations of Auctions & Account Holders

17.1. Infinity Auctions Network may terminate or suspend auctions at any time without prior notice.

17.2. Infinity Auctions Network may terminate or suspend your access to our services at any time without liability.

17.3. Infinity Auctions Network reserves the right to temporarily block any Account Holder from further bidding activity at any stage—before, during, or after any sale.

17.4. Infinity Auctions Network also reserves the right to permanently ban any Account Holder from further bidding activities across all platforms where Infinity Auctions Network operates.

18.0 Payment Terms and Consequences for Non-Payment

18.1. Payment Obligation
18.2. Payment for any lot won at auction must be made strictly within 24 hours of the auction’s conclusion.
18.3. Failure to remit payment within 48 hours without prior agreement with Infinity Auctions Network constitutes a breach of contract and failure to complete the transaction.

18.4. Consequences of Non-Payment
18.5. If payment is not received within 48 hours, the lot will be withdrawn from the winning bidder. Additionally, the following measures will apply:

• An invoice will be issued to the winning bidder for the Buyer’s Premium, which must be paid within 7 days.

18.6. Buyer’s Premium
18.7. The Buyer’s Premium is 15%–20% of the hammer price of the lot, depending on the lot type.
18.8. The specific Buyer’s Premium for each lot is disclosed under the “Additional Fees” section on the lot page.

18.9. Further Penalties for Non-Payment
18.10. If the Buyer’s Premium invoice is not paid in full within 7 days, the following penalties will be imposed:
a. Non-Payment Interest: Interest at a rate of 8% per annum, calculated daily, on the total outstanding invoice amount.
b. Administration Fee: An additional administration fee of £295.
c. Debt Recovery Charges: The debt will be referred to a commercial debt recovery company, rendering the buyer liable for all debt recovery and legal costs, including but not limited to 15% of the total invoice amount, payable to the Company.

18.11. Acknowledgement of Terms
18.12. By accepting the Terms & Conditions of the auction and placing a bid, the buyer acknowledges and agrees to all terms set forth herein, including penalties and recovery procedures in the event of non-payment.
18.13. No exceptions shall be made under any circumstances.

18.14. Legal Enforcement
18.15. Any unpaid amounts will be pursued in accordance with applicable laws, and the buyer remains fully liable for all costs arising from non-compliance with these terms. This policy shall be strictly observed to prevent further charges or legal escalation.

19.0 Warranty and Liability

19.1. Infinity Auctions Network, acting as the auctioneer, is not a party to the contract between the buyer and the vendor. We disclaim any liability for actions or defaults of the vendor or buyer.

19.2. Lot descriptions are based on information provided by the vendor. Infinity Auctions Network assumes no liability for any losses, damages, or injuries resulting from the sale.

19.3. Trade-only auctions are not governed by the Sale of Goods Act 1979, the Consumer Rights Act 2015, or related consumer legislation. By bidding, you acknowledge and agree to this exclusion.

20.0 Confidentiality and Non-Circumvention

20.1. Both parties undertake to maintain the confidentiality of any information obtained during the auction process and shall not disclose it to any third party without prior written consent.

20.2. Buyers shall not engage directly with Infinity Auctions Network’s vendors, suppliers, or consignors without the express written permission of Infinity Auctions Network.

21.0 Feedback and Disputes

21.1. Infinity Auctions Network values feedback for the improvement of its services. Any concerns should be communicated directly to Infinity Auctions Network for resolution.

21.2. Feedback regarding specific vendors should be relayed to them directly and should not be published publicly on Infinity Auctions Network’s platforms.

21.3. Infinity Auctions Network reserves the right to act against any false or misleading feedback that harms the company’s reputation.

22.0 Governing Law and Jurisdiction

22.1. These Terms & Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Infinity Auctions Network Ltd is registered.

22.2. Any legal action or proceeding arising from or related to these Terms & Conditions shall be exclusively brought before the competent courts of that jurisdiction.

23.0 Amendments to Terms of Sale / Terms & Conditions

23.1. Infinity Auctions Network reserves the right to modify these Terms of Sale or Terms & Conditions at any time without prior notice to any Account Holder or prospective bidder.

23.2. It is the responsibility of all returning bidders to remain informed of any updated Terms of Sale / Terms & Conditions.

All lots are sold at the discretion of Infinity Auctions Network Ltd which reserves the right, on behalf of itself or the vendors, to:

• Set a reserve price: Infinity Auctions Network Ltd may establish a minimum “reserve price.”
• Bid on behalf of a vendor up to the vendor’s reserve price: Infinity Auctions Network may place bids during the auction on behalf of the vendor, not exceeding the reserve price.
• Allow the vendor to bid up to the reserve price: The vendor may, in certain circumstances, bid on their own item to reach the reserve price (“vendor bid”).
• Withdraw a sale at any time: Infinity Auctions Network Ltd may cancel or withdraw a sale at its discretion for reasons including, but not limited to, listing errors or unforeseen circumstances.
• Rearrange, consolidate, or vary the order of sale: The auctioneer may alter the order in which lots appear or consolidate similar items at its discretion.
• Decline to disclose the reserve price: Infinity Auctions Network may choose to keep the reserve price confidential or disclose it to bidders, at its discretion.
