General Conditions of Sale THIS IS AN ONLINE TIMED AUCTION – THERE WILL BE NO ONSITE BIDDING,
ALL BIDS WILL BE ONLINE Auction Times & Dates - Commencing 10am 5th October & Closing 9th October 2024 from 10am onwards. Viewing will be on Friday 4th October 2024 10am – 4pm
All persons attending the viewing day are reminded that there may be risks on the site including moving vehicles and machinery.
General Conditions of Sale
1. Anybody selling, bidding, or buying at our sales is deemed to have read and understood these conditions and to agree to be bound by them. In these conditions “we” means Shouler & Son. The sale is conducted under the conditions of those prepared by the Livestock Auctioneers Association (October 2018) alongside the below special conditions. Full Terms & Conditions of our Auction can be found on our website.
2. This auction operates according to the terms of sale outlined by The Livestock Auctioneers Association (October 2018), alongside specific conditions listed below. Copies of these terms are available at the Auctioneers' payment office
3. The highest bidder will be deemed the Purchaser (though the Auctioneers reserve the right to decline any bid). In case of a dispute during the final bid, the Lot will be re-auctioned or the Auctioneers may designate the purchaser.
4. All potential buyers must identify themselves to the Auctioneers prior to the sale, providing their full name, business name, address, and contact details.
5. VAT at the prevailing standard rate will be added to all purchases unless stated otherwise
6. All descriptions, written or verbal, are for guidance only. Neither the Auctioneers nor the vendors are liable for the accuracy of descriptions. Lots are sold with all faults, and buyers must assess condition prior to purchase, relying on their own judgment.
7. Purchasers are responsible for ensuring that all plant machinery or equipment complies with the Health & Safety at Work Act 1974 before use. 5. Prospective buyers unknown to the Auctioneers must present a BANK REFERENCE before purchasing. Cash transactions exceeding £10,000 sterling will not be accepted. Payment methods include BANKER’S DRAFT, CHEQUE WITH GUARANTEE CARD/BANK REFERENCE.
8. The Auctioneers determine the bidding rate.
9. Failure to pay for any Lot(s) by the purchaser will result in resale, with any resulting deficit or costs the responsibility of the original purchaser.
10. The Auctioneer, acting as the vendor's agent, reserves the right to bid up to the reserve price, if set, on any Lot.
11. Full payment is due immediately after the hammer falls, and the PURCHASER assumes full responsibility for the Lot. Lots cannot be removed until payment is complete.
12. Removal of Lots requires proof of payment.
13. The vendor and the Auctioneers, as the vendor’s agent, retain ownership of Lots until full payment is received. Outstanding payments will incur interest at 4% above the Bank Base Lending Rate.
14. In all cases of transfer, the original purchaser is liable for the purchase price.

The sale will take place at Sysonby Lodge Farm, 2 Nottingham Rd, Melton Mowbray LE13 0NX note this is an online auction only and no live sale shall take place on site. Signposts will be erected for the view day. POST CODE: LE13 0NX
2. CAR PARKING
Car parking will be available on site.
3. VALUE ADDED TAX
Bids made for lots which attract Value Added Tax shall be exclusive of VAT chargeable. Purchasers should retain the invoice and catalogue from the auctioneers. These documents will be required to support their VAT account and will constitute their tax invoice. VAT will be payable on lots bought for export and will not be refunded until all proper procedures are complete.
4. PAYMENT
Payments will be requested once invoices have been sent and we are able to take Debit card or bank transfer. All invoices will be sent with our bank account details for online payment with reference. Credit cards will NOT be accepted
5. Buyers Premium (BP) and Value Added Tax (VAT)
A Buyer’s premium of 5% of the hammer price is payable on all lots up to a maximum of £400 per lot. This is subject to VAT @ 20%. For reference any lot sold at £8,000 or under will attract a 5% buyers premium. Any lot over £8,000 will have a fixed buyer’s premium of £400, also subject to VAT @20%.
Online bidding will be available for this sale via i-bidder.com or Bidspotter. co.uk. A 3% plus VAT internet surcharge will be added to the hammer price for successful bids made online through i-bidder.com or Bidspotter. co.uk
6: COLLECTION
We are able to assist in the collection of items from the 10th october - 12th October only between 9.30am -4.30pm. Any collection of items after those dates, we, the auctioneers may not be able to assist in the loading, and individual loading provisions must be arranged.
