Please Note:
(a) We will not allow removal of any Lot from the Sale site until our Accounts Department has received notification from our bankers that your payment has been properly cleared in full. Monies must be transferred to ourselves within the time stated in the “Notice to Purchasers”.
(b) If there are any special arrangements that you wish to make with us, you must contact us at least three days before the Sale date.
(c) Our terms regarding payment of VAT and subsequent refunds.
VAT on Goods Destined for Export:
All purchasers intending to export their purchases will be charged a deposit equal to that of the VAT due on each lot purchased and the Buyer’s Premium.
In order to qualify for a refund, the goods must be exported in accordance with regulations under “Indirect Export” and valid evidence of export received by Lambert Smith Hampton within one month of the date of export. Where satisfactory evidence is not provided, goods and services will be subject to UK VAT at the standard rate and the deposit will not be refunded.
Please ensure that the cashier has been notified of your intentions to export prior to removal of goods.
International Bank Charges: Please note we will look to recover charges incurred on the transfer of the VAT deposit refunded.

6.4 Liability for Damages: The Auction House shall not be liable for any damage or loss—direct or indirect—arising from removal, transportation, or installation of any purchased item.
7.1 No Liability for Indirect or Consequential Loss: To the fullest extent permitted by law, Vicarage Auctions and its officers, employees, or agents shall not be liable for any indirect, special, incidental, or consequential damages of any kind, including but not limited to loss of profits or business interruption.
7.2 Maximum Liability: Our maximum liability to any buyer or seller shall not exceed the amount of the buyer’s premium or seller’s commission actually received by us in connection with the applicable lot.
7.3 Reliance on Information: While we endeavor to provide accurate information regarding each lot, we do not accept any liability for errors or omissions, and bidders rely on their own inspection and due diligence.
7.4 Force Majeure: We shall not be liable for any delay or failure to perform our obligations under these T&Cs arising from any event or circumstance beyond our reasonable control (including natural disasters, strikes, or technical failures).
8.1 Ownership & Authority: By consigning a lot, you warrant that you have the right to sell the item and that all relevant permissions or licenses have been obtained.
8.2 Accurate Descriptions: You must provide accurate information and disclose any material defects known to you.
8.3 Indemnification: You agree to indemnify and hold Vicarage Auctions harmless against any claims, losses, or damages arising out of your breach of these T&Cs or the sale of any lot.
9.1 Governing Law: These T&Cs and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of [applicable jurisdiction].
9.2 Arbitration or Court: Disputes shall be resolved by the courts of [applicable jurisdiction] unless we agree to seek arbitration.

3.4 Withdrawal of Lots: We reserve the right, at our discretion, to withdraw any lot prior to or during an auction without incurring liability or providing notice.
4.1 Buyer’s Premium/Fees: A buyer’s premium and/or other fees may apply. These charges will be stated clearly in the auction listing or on our website.
4.2 Payment Terms: Full payment for any purchased lot must be made within the time specified after the auction ends. Payment methods accepted will be stated in the auction listing or on our website.
4.3 Late Payment/Default: If you fail to pay on time, we reserve the right to cancel the sale, resell the item, and/or charge you for any resulting losses or costs.
5.1 “As Is, Where Is”: All lots are sold on an “as is, where is” basis with no representations or warranties—express or implied—by Vicarage Auctions. Any descriptions, images, or condition reports are provided only to assist potential buyers and do not create any warranty regarding the item’s condition, fitness for purpose, or merchantability.
5.2 Inspection: It is your responsibility to inspect any lot you intend to bid on or to seek independent advice if you are unable to inspect personally. We do not accept returns, cancellations, or exchanges based on the condition of a lot.
6.1 Buyer’s Responsibility: Once a lot is sold, it is the buyer’s sole responsibility to arrange for shipping, removal, and any related costs.
6.2 Risk & Title: Risk passes to the buyer immediately upon the close of bidding. Title passes when full payment is received and cleared.
6.3 Third-Party Services: We may recommend shipping or removal services as a courtesy; however, we do not endorse or guarantee their services and accept no liability for any issues or damage.
6.4 Liability for Damages: The Auction House shall not be liable for any damage or loss—direct or indirect—arising from removal, transportation, or installation of any purchased item.
7.1 No Liability for Indirect or Consequential Loss: To the fullest extent permitted by law, Vicarage Auctions and its officers, employees, or agents shall not be liable for any indirect, special, incidental, or consequential damages of any kind, including but not limited to loss of profits or business interruption.
7.2 Maximum Liability: Our maximum liability to any buyer or seller shall not exceed the amount of the buyer’s premium or seller’s commission actually received by us in connection with the applicable lot.
7.3 Reliance on Information: While we endeavor to provide accurate information regarding each lot, we do not accept any liability for errors or omissions, and bidders rely on their own inspection and due diligence.
7.4 Force Majeure: We shall not be liable for any delay or failure to perform our obligations under these T&Cs arising from any event or circumstance beyond our reasonable control (including natural disasters, strikes, or technical failures).
8.1 Ownership & Authority: By consigning a lot, you warrant that you have the right to sell the item and that all relevant permissions or licenses have been obtained.
8.2 Accurate Descriptions: You must provide accurate information and disclose any material defects known to you.
8.3 Indemnification: You agree to indemnify and hold Vicarage Auctions harmless against any claims, losses, or damages arising out of your breach of these T&Cs or the sale of any lot.
9.1 Governing Law: These T&Cs and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of [applicable jurisdiction].
9.2 Arbitration or Court: Disputes shall be resolved by the courts of [applicable jurisdiction] unless we agree to seek arbitration.
9.3 Claims: If you wish to make a claim against us relating to any auction, you must do so in writing within a reasonable time. If no claim is made, we shall consider the matter closed.
10.1 Data Collection: We collect and use personal data in accordance with our Privacy Policy.
10.2 Consent: By registering or bidding, you consent to our collection and use of your information as described in our Privacy Policy and any applicable data protection laws.
11.1 Severability: If any clause or part of a clause in these T&Cs is found to be invalid or unenforceable by a court or regulator, it shall be deemed modified to the minimum extent necessary to make it valid, and the remaining clauses shall remain in full force.
11.2 No Waiver: Failure by Vicarage Auctions to enforce any provision shall not be deemed a waiver of future enforcement of that or any other provision.
11.3 Entire Agreement: These T&Cs constitute the entire agreement between you and Vicarage Auctions regarding your participation in our auctions.
